    Orange County Court Process

    An Orange County DUI case typically begins when you are arrested by a police officer for DUI.  The officer forwards his/her arrest report to the Orange County District Attorney’s Office.   Your arrest report will then be reviewed by a charging deputy at the District Attorney’s office and this deputy will decide whether or not to file charges against you.  Most DUI cases are charged as misdemeanor offenses.  This means that many times your DUI attorney can appear in Court without you being present. The first Court appearance is known as your arraignment.  It is at the arraignment that your skilled DUI defense attorney will most likely enter a plea of “not guilty” on your behalf and set your matter for a pre-trial.  At the pre-trial stage your experienced DUI lawyer will able to fiercely negotiate your case with the district attorney.  Your skilled attorney will then help you decide if the best option is to enter into a plea bargain or take your case to trial.  The Parker Law Center is committed to getting the best possible outcome in your case so call today to receive the representation you need and deserve.

    Orange County DMV Process

    The DMV process begins once you are arrested for DUI.  The arresting officer will take away your California driver’s license and provide you with a pink sheet of paper.  This pink sheet serves as your temporary license.  This temporary license provides you with full driving privileges for 30 days then your license is automatically suspended.  The only way to delay this suspension is to request an Administrative Per Se (APS) hearing with the City of Orange Driver Safety Office within 10 days of your DUI arrest.  A skilled DUI attorney will request this hearing on your behalf and place a stay on the license suspension so you maintain full driving privileges up until a decision is rendered from your APS Hearing.

    The APS Hearing is conducted with a Hearing Officer, who is an employee of the City of Orange Driver Safety Office. The Hearing Officer has the burden of proving the following issues:

    If the driver submitted to a chemical test there are three issues:

    • Did the officer have reasonable cause to believe that the licensee was driving a motor vehicle in violation of California Vehicle Code Sections 23152 or 23153?
    • Was the licensee lawfully arrested?
    • Was the licensee driving a motor vehicle with 0.08% or more, by weight, of alcohol in the blood?

    If the driver refused to submit to or failed to complete a chemical test (a refusal) there are four issues:

    • Did the officer have reasonable cause to believe that the licensee was driving a motor vehicle in violation of California Vehicle Code Sections 23152 or 23153?
    • Was the licensee lawfully arrested?
    • Was the licensee advised that refusal to submit to, or failure to complete, a breath or blood test would result in a one year license suspension or two or three year revocation?
    • Did the licensee refuse to submit to, or fail to complete, a chemical test after being requested to by a peace officer?

    The APS Hearing begins with the Hearing Officer entering documents into evidence supporting the above issues on why your license should be suspended.  A competent Orange County DUI lawyer will make fierce objections to these documents and provide rebuttal evidence.
