    Mission Viejo DMV Process

    In most DUI arrests in Mission Viejo, the arresting officer will confiscate the arrestee’s license and provide him/her with a pink piece of paper that serves as a temporary license. This temporary driver’s license provides the driver with full driving privileges for 30 days from the date of their arrest. If the driver takes no further action then his/her license will become automatically suspended 30 days from the date of arrest. However you have a right to fight this license suspension.     • Was the licensee lawfully arrested?
    • Was the licensee advised that refusal to submit to, or failure to complete, a breath or blood test would result in a one year license suspension or two or three year revocation?
    • Did the licensee refuse to submit to, or fail to complete, a chemical test after being requested to by a peace officer?

    During the APS Hearing, the Hearing Officer will present documents into evidence.
