    Court Process for DUI Arrest in Laguna Niguel – Harbor Justice Center

    Since September 2005, the DMV is charged with all license suspensions resulting from DUI arrests and convictions.  There are two suspensions which can result from a DUI offense.  The first suspension is triggered by arrest, while the second suspension is triggered if the licensee is convicted in court of DUI.  Following your DUI arrest the arresting officer will take away your driver’s license and provide you with a pink sheet of paper which will serve as your temporary license.  This temporary license is only valid for 30 days, after that time the license will become suspended.  In order to prevent this automatic suspension, your experienced Laguna Niguel DUI attorney must request an APS (Administrative Per Se) hearing through the City of Orange Driver Safety Office within 10 days of your arrest.  Your lawyer will request the APS hearing and have a stay put on your license.  It is critical that you hire a skilled Laguna Niguel DUI attorney in order to maintain your driving privileges until a decision is rendered on your hearing.

    • Was the licensee advised that refusal to submit to, or failure to complete, a breath or blood test would result in a one year license suspension or two or three year revocation?
    • Did the licensee refuse to submit to, or fail to complete, a chemical test after being requested to by a peace officer?
