    Huntington Beach Court Process

Many times a Huntington Beach DUI case begins by a police officer citing a person for driving under the influence. The citation provides the person with a date to appear in Court. Once a citation has been issued, the Huntington Beach police officer will forward his/her arrest report to the Office of the Orange County District Attorney (OCDA). A filing deputy with the OCDA is charged with reviewing the report and deciding whether or not to file a complaint in Court against the person. Typically a DUI is filed as a misdemeanor offense. If you have been arrested for a DUI in Huntington Beach, many times your Huntington Beach DUI attorney has the ability to appear in Court without your presence at the Westminster Justice Center.

The date to appear in Court on the citation is called the arraignment. The arraignment is the Court appearance in which the charges on the complaint are read and a plea of “guilty” or “not guilty” is entered. Many times your Huntington Beach DUI lawyer will enter a plea of “not guilty” on your behalf and set your case for a pre-trial. There are certain circumstances in which keeping your matter at the arraignment stage will help facilitate the best disposition; thus, your DUI lawyer may continue your arraignment. If your matter is set for a pre-trial, your Huntington Beach drunk driving lawyer will negotiate with the prosecutor assigned to your matter and may request additional discovery. The pre-trial is the stage which allows your Huntington Beach DUI attorney to evaluate your case and determine if pre-trial motions should be filed. Depending on the exact components of your case, a plea bargain could be in your best interest; other times, your Huntington Beach defense lawyer could recommend you set your matter for trial. Call the Parker Law Center for an evaluation of your case!

    Huntington Beach DMV Process

During a typical DUI arrest in Huntington Beach, the police officer will take the offender’s license and provide him/her with a temporary driver’s license. The temporary driver’s license allows the driver for the next 30 days to maintain full driving privileges.  Should the driver take no further action, his/her license will become suspended. The length of the suspension is determined by the number of actions the DMV has taken on the person’s license. You have a right to fight this license suspension. If you have been arrested for a DUI in Huntington Beach, it is imperative you contact the City of Orange Driver Safety Office within 10 days of the date of arrest. An experienced Huntington Beach DUI defense attorney will request this hearing on your behalf as long as you have contacted the attorney within the first 10 days. A competent DUI defense attorney will request the APS Hearing, in addition to a stay on the license suspension and discovery. The City of Orange Driver Safety Office will provide you with a new temporary license which will enable you to maintain full driving privileges up until the time a decision is rendered on the hearing. The APS hearing is conducted by a representative of the DMV known as a Hearing Officer. The Hearing Officer has the burden of proving the following issues:

If the driver submitted to a chemical test there are three issues:

    • Did the officer have reasonable cause to believe that the licensee was driving a motor vehicle in violation of California Vehicle Code Sections 23152 or 23153?
    • Was the licensee lawfully arrested?
    • Was the licensee driving a motor vehicle with 0.08% or more, by weight, of alcohol in the blood?

If the driver refused to submit to or failed to complete a chemical test (a refusal) there are four issues:

    • Did the officer have reasonable cause to believe that the licensee was driving a motor vehicle in violation of California Vehicle Code Sections 23152 or 23153?
    • Was the licensee lawfully arrested?
    • Was the licensee advised that refusal to submit to, or failure to complete, a breath or blood test would result in a one year license suspension or two or three year revocation?
    • Did the licensee refuse to submit to, or fail to complete, a chemical test after being requested to by a peace officer?

At the APS hearing, the Hearing Officer is charged with entering the documents into evidence. Your Huntington Beach DUI defense lawyer should be skilled at objecting to the documents and presenting rebuttal evidence. At the conclusion of the hearing, the Hearing Officer takes all of the evidence under submission and is charged with rendering a written decision. The decision will be sent to both the licensee’s address and the attorney’s office. The decision may appear within a few days or weeks depending on the Hearing Officer’s schedule. The decision will either set aside the suspension or uphold it.
