    Court Process for DUI Arrests in Anaheim

    The Court process typically begins when a person is arrested for driving under the influence in Anaheim. The peace officer will forward his/her arrest report to the Office of the Orange County District Attorney for review, in addition to providing the arrestee with a citation to appear in Court. Once the Office of the Orange County District Attorney receives the arrest report, it will be forwarded to a charging deputy. The charging deputy is charged with reviewing the report and determining which charges are appropriate, if any, it be filed in Court. Most DUI arrests are filed as misdemeanors.     If the driver refused to submit to or failed to complete a chemical test (a refusal) there are four issues:

    • Did the officer have reasonable cause to believe that the licensee was driving a motor vehicle in violation of California Vehicle Code Sections 23152 or 23153?
    • Was the licensee lawfully arrested?
    • Was the licensee advised that refusal to submit to, or failure to complete, a breath or blood test would result in a one year license suspension or two or three year revocation?
    • Did the licensee refuse to submit to, or fail to complete, a chemical test after being requested to by a peace officer?

    At the start of the APS hearing the Hearing Officer introduces all documents on to the record and identifies them as exhibits.
